STATUTES
|
| NAME |
| |
The name of the Society shall be THE KENYA NATIONAL CHILDREN GAMES FEDERATION (in this constitution referred to as “the society”).
|
| OBJECTS |
| |
| (a) |
Actively organize, plan, involve and participate fully in all youth sports activities and exchange programs both locally and internationally for both male and female children of 18(eighteen) years of age and below. |
| (b) |
Actively organize, plan, involve and participate fully in all youth cultural activities and programs both locally and internationally for both male and female children of 18(eighteen) years of age and below. |
| (c) |
Actively organize, plan, involve and participate fully in all educational activities and educational programs both locally and international for both male and female children of 18(eighteen) years of age and below. |
| (d) |
Participate and involve in any other viable but lawful activities aimed at promoting and benefiting the wellbeing of our targeted children youths of age 18 (eighteen) years and below. |
| (e) |
Affiliate, liaise and work closely and in consultation with the already existing but legally established national and international sports, cultural and educational organizations and, or institutions. |
| (f) |
The society shall totally be non political organization, promote and preach peace as one of its major policies to all its associates, partners and affiliate members while promoting and involving youths in sports, culture and educational activities and programs. |
| (g) | The society shall form branches countrywide at provincial, district, divisional and location level where possible and necessary. This shall be done with the approval of a majority of 75% of the total number of members of the national executive committee in a legally and properly convened meeting called by the national secretary general. In establishing such branches, viability and success of such branches shall always have to be taken into consideration. Members of such branches will have to be thoroughly vetted by the national executive committee in order to ensure their honesty, sincerity, accountability and transparency. This will be one of the most important qualifications in establishing branches and even for any incoming new members of the society.

| (h) |
The society shall legally develop clear objectives, aims, goals, vision and mission that will enable it achieve all the above objects. The society shall also develop and run its own website which shall display its constitution and its development programs. |
| (i) |
Ensure all members adhere to peace and all committee members is honest, sincere, transparent, and accountable and respect fully the society’s constitution, rules and policies. This shall be one of the society’s major objectives and members disregarding or failing to respect it will face serious disciplinary action(s) by the society’s disciplinary committee which will include deregistration of such member(s). |
| (j) |
The society shall establish and manage a national youth sports academy as one of its major objects. The society will also source for professional clubs and scholarships and funds to assist the bright children who excel in sporting, cultural and educational activities organized by the society. |

| VISION |
| |
To establish youth sports centers at Village level and within urban centers, ensuring their viability, success and professionalism and that such centers become greatly beneficial to the local children and youths within the respective areas of establishment. |
| GOALS |
| |
To develop and come up with formidable, competitively disciplined and professional youth sports teams of various sports disciplines with a view to assist feed the country’s various national sports bodies affiliated to International sports federations.
To help ensure that sports truly become one of the employment centers for the rapidly growing Kenyan youths and help develop further, the love for sports as is the case with developed countries.
To use sports as one of the ways in promoting peace and friendship both locally and internationally and to reduce.
unemployment and the highly growing number of street children and idle youths in the country. |
MEMBERSHIP |

| (a) |
Any PERSON over the Age of eighteen years shall be eligible for membership of the society and shall, subject to the approval of the national executive committee, become a member on payment of an entrance non-refundable registration fee of Kenya Shilling5000.00, a refundable membership fee of Kenya shillings 3500.00. |
| (b) |
Any institution or organization shall be eligible for membership of or Affiliation to the society and shall, subject to the approval of the national executive committee, become a member or affiliate on payment of an entrance non-refundable registration fee of Kenya Shilling 20,000.00 and a refundable membership fee of Kenya shillings 5000.00

| (c) |
Any child or youth below the Age of eighteen years shall be eligible for free membership of the society but shall participate or involve in the management of the society only as a competitor or player. Such a child or youth shall, if directed by the society through the Secretary General or the national executive committee, pay a maximum of Kenya Shillings 5000.00 being participation fee for the event or competition in place. |
| (d) |
Every member over the age of eighteen years shall pay a monthly subscription fee of Kenya Shillings 5000.00 to the Society while every institution accepted as member/affiliate of the society will pay Kenya shillings 10,000.00 per month, not later than the 10th day of each month. |
| (e) |
Any member desiring to resign from the society shall submit his resignation to the Secretary General, which shall take effect from the date of receipt by the Secretary General of such notice.

| (f) |
Any member may be expelled from membership if the executive committee so recommends and if a general meeting of the society shall resolve by 75% majority of the members present and that such a member should be expelled on grounds that his or her conduct has adversely affected the reputation or dignity of the society. The executive committee shall have power to suspend a member from his membership until the next general meeting of the society following such suspension but not withstanding such suspension a member whose expulsion is proposed shall have the right to address the general meeting at which his expulsion shall be considered. |
| (g) |
Any member who resigns or is removed from membership shall not be entitled to a refund of his subscription or any part thereof or any moneys contributed by him at any time. |
| (h) |
Any member who falls into arrears with his monthly subscription for more than six months shall automatically cease to be a member of the Society and his name shall be struck off the registration of members. The executive committee may, however, at its discretion, reinstate such a member on payment of the total amount of subscription outstanding. |

FOUNDER |
| |
It is important to note that it was the sole idea of the Founder of the society in establishing this society, playing a crucial role in determining the society’s Vision, Aims, Objectives, Goals and also scouting for the society’s first office bearers. Therefore in order for the society to appreciate this, the Founder will always remain a permanent office bearer and life member of the society and all its committees and shall always be one of the decision makers in the day to day management of the society and ensure the society’s permanent existence and continuity. In the event of his retirement or death, a person already Nominated by him shall take this position and ensure continuity of the Society. The Society’s Founder will be non other than The First Secretary General and Chief Executive Officer (CEO) of the Society at the time of its Registration. This rule is caused by the fact that there are many people whose intention to join the society will be ill intentioned with a view to messing up the society after which they run away without any care of the society’s future. |
TRUSTEES |

| (a) |
All land, building and other immovable property, and all investments and securities which shall be acquired by the society shall be vested in the names of not less than 3 Trustees
who shall be members of the society and shall be appointed at an annual general meeting for a period of five years. On retirement, such trustees shall be eligible for re-election. A general meeting shall have the power to remove any of the trustees and shall be filled at the same or next general meeting.

| (b) |
The Trustees shall pay all income received from property vested in the Trustees to the Treasurer. Any expenditure in respect of such property which in the opinion of the Trustees if necessary, or desirable shall be reported by the trustees to the Executive committee, which shall authorize expenditure of such A money as it thinks fit. |

AUDITOR |

| (a) |
An Auditor shall be appointed by the annual general meeting. All the Society’s Accounts, records and documents shall be opened to the inspection of the Auditor at any time. The Treasurer shall produce an account of the society receipts, payments and a statement of assets and liabilities made up to a date of the annual general meeting. The Auditor shall examine such annual accounts and statements and either clarify that they are correct, duly vouched and in accordance with the law or report accordingly to the society in what they are found to be incorrect, untouched or not in accordance with the law. |
| (b) |
A copy of the Auditor’s report on the accounts and statements of the society, together with such accounts and statements shall be furnished to all members of the society at the same time as the notice convening the annual general meeting is sent out. An Auditor may be paid such honorarium for his duties as may be resolved by the annual general meeting appointing him or her, through recommendations of the executive committee.

| (c) |
No Auditor shall be an office bearer or a member of the executive or any of the society’s committees. |
|
FUNDS |
| |
The Society shall make written Financial and Material appeals and, or requests and send to various sponsors and donors through the Secretary General and Chief Executive Officer. Moneys or materials received from such sponsors or donors will be directed towards such specific events that the appeals and requests were meant for and according to the budget for such activities or events.
The Society shall enter into various legal businesses of its own or business partnerships with other legally and well established organizations, as one of its major ways of raising income or funds for managing many of its activities and events. However, incase of business partnership and associations, there will have to be a properly written and well-defined business agreements prepared and signed by lawyers and officials of both partners and associates. The Secretary General and Chief Executive Officer of the Society will lead this.
Talented and Competent Children coming from financially able families or schools will pay for the cost of expenses of sports or activities they will be participating in as organized by the society. Money generated from such children will be used to pay for the expenses of talented sports children coming from families or schools that are not financially able. Funds will also be raised by way of making various financial and material appeals to different sponsors. Should such appeals be successful then it will be at the discretion of the society to exempt children coming from financially able schools or families in paying for expenses of events they are participating in.
| (a) |
The Funds of the society may be used for the following purposes;-
| (1) |
Managing the society’s financial affairs in implementing theSociety’s Objects as described in Rule 2. |
| (2) |
Paying members allowances, staff salaries and any other expenses as approved by The Secretary General/Chief Executive Officer (CEO) and, or the Executive committee. |

| (b) |
All moneys and funds of the society shall be received by, and paid to the
Treasurer in liaison and through the supervision of the Secretary General and shall be deposited to the Bank or Banks approved by the committee as per the Constitution.
|
| (c) |
No payments shall be made out of the Bank Account without the approval or a resolution of the executive committee authorizing such payments. |
| (b) |
Such payments from the society’s bank account shall be signed by the Treasurer or in the absence of the treasurer the Assistant Treasurer, the Secretary General and one other person preferably the Chairman or one other permanent office bearer of the society who shall be appointed by the Executive committee.

The Financial year of the society shall be 31st December of every year.
NOTE: - The purpose of the society shall be concise as much as possible and must be consistent with the objects of the society in rule. |

|
BRANCHES |
| |
Branches of the society may be formed with the approval of the committee and the Registrar of the societies and they will adopt the same constitution as that of the headquarters with the following exceptions:
The aims and objects will not include the formation of Branches.
Amendments of the constitution can only be made by the headquarters of the society in accordance with the provisions of rule 14.
The provisions of rule 15 shall apply to branches but, in addition, will not be dissolved without consultation and approval of the headquarters of the society.
NOTES:
- This rule should only be included in the constitution of the society if it wishes to form branches.
- All such branches are required to be registered under the society Act, 1968.

INSPECTION OF ACCOUNTS AND LIST OF MEMBERS |

The books of accounts and all documents relating thereto and a list of the members of the society shall be available for inspection at the registered office of the society by any officer or member of the society on giving not less than 7 days written notice to the society.
